The former personal attorney for Donald Trump has resigned as the US Attorney for New Jersey. This comes after a legal ruling that challenged her eligibility to occupy the role.

Acceptance of Resignation

The nation's top law enforcement official, Pam Bondi, announced the prosecutor's departure on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for Habba to effectively run her office.

"Let no one confuse adherence to the ruling as defeat," she declared. "My fight will now extend throughout America."

Judicial Challenge

Her resignation was triggered by a federal appellate panel ruled that she had been acting without proper authority as the top prosecutor. This ruling is likely to affect scores of prosecutions in New Jersey.

The appellate judges declared that a temporary posting that bypassed Senate approval ran afoul of the federal law governing appointments.

Future Role and Reaction

It was also stated that the former prosecutor will stay on at the DOJ as a senior adviser. Habba plans to seek further review of the disqualification, in the hope of achieving a overturned decision.

In a statement, Bondi wrote that judges "must not override the executive's selection of prosecutors entrusted with executing the fundamental role of the presidency of enforcing the law."

She highlighted her tenure and pointed out that during her run, the Newark saw a one-fifth decrease in crime. Additionally that the city of Camden recorded its first summer in 50 years without a homicide.

Connection to Donald Trump

Habba, first joined Donald Trump's lawyers in recent years. She went on to defended her client in his business records case in New York last year, which resulted in his guilty verdict on dozens of charges of financial record manipulation.

Prior to Habba took on the federal prosecutor position, Donald Trump had announced he was selecting her as his senior adviser if re-elected, describing her as a steadfast ally and a relentless legal advocate.
